The schools of organization theories Essay The schools of organization theories serve as the poles of support in keeping the order in an organization through the organizational functions. Each school of thought functions in a unique way causing changes in a certain work environment. The four schools of organizations theories that were listed are the human relations approach, neo- human relations school, the theories X, Y and Z (also known as the theories of motivation) and the systems approach. Major organizations that make use of the said theories include the finance undertakings, operations or productions, marketing and personnel purposes. These functions must be executed effectively and efficiently to be able to achieve the organization’s objectives. The organizational theories are manifested to almost all functions but in order to see a clearer perspective, specific reflections of the theories to each organizational function will be laid down. The human relations approach applies to the personnel functions. It dwells on the change of relationship between the leader and the subordinate. There is existence of decentralization and decision-making which let the employees be involved to enhance skills. The neo- human relations school is the â€Å"upgraded† version of the human relations school. Thus, it can also be reflected in the personnel functions. The said organizational theory patterns its principles to the Maslow’s hierarchy of needs. But, viewing form another perspective, the theory can also be utilized through meeting the goals of the marketing division. In marketing processes, advertising of a certain business entails the consideration of psychological aspects. In considering which marketing strategy to use, getting the consumer to respond to a certain product is important. This can be done through highlighting the achievement of human needs in an advertisement. For example, a television advertisement about a body spray targets the market segment of teenagers. So, the advertisement will highlight the need of teenagers to gain self-esteem through showing scenes in the advertisement that once a teenager will use that body spray, he or she will gain admiration from the opposite sex. Therefore, if and when the message was conveyed to the target market, the marketing function of the business will be accomplished. The third school of organizational theory is composed of the Theories X, Y and Z which somewhat clash in the purposes of managing the workplace. But, these are of great help in managing again the function of the personnel division. Theory X deals with a stricter work ethics to motivate the employees while Theory Y stated that workers have indeed a sense of self-direction. On the other hand, Theory Z (the hybrid of the Japanese and American management), incorporates the principles of creating a strong bond between the company and the employees through valuing the human resource development. Lastly, the systems approach is manifested through the technical functions of finance and production. The theory caters the requirements for financial matters through the open and closed systems. The open system as the name speaks for itself, caters boundaries that can be penetrated while the closed system has more rigid boundaries. It is up to the financial management on whether adjustments will be done in investments through accepting the influence of external factors or keeping everything as internal matters. For the operations or productions, the company can decide on whether adopting an open or closed system. Manufacturing lines can be subject to the transformation model if there is demand to do so. The company or the business can adapt the organizational theories for further improvement but it must be noted that some concepts of the theories can also hinder progress. As for the human relations and the neo-human relations approach, a concrete line must be drawn so to not abuse the professional ethics. It is true that the two theories give utmost importance in establishing individual autonomy to the employees, the leaders or managers must still be able to exercise power over major organizational matters. There must only be a right dose of relationship-oriented activities so that the work-related activities will not be overpowered. Otherwise, the sense of leadership will be obliterated. The theories X and Y must be adapted in a careful manner since the two are polar extremes. If Theory X is implemented in a leadership aspect, rebellion might occur in the workplace due to very authoritarian rules. The leader may solicit suggestions from the workers but still ahs the power to decide on whether to accept those suggestions or not. With this kind of management, conflict will definitely arise since the workers might think that the efforts are just put to waste. It must be made sure that the intensity of implementing it is well-adjusted to the needs of the organization. Theory Y does leadership in a lighter way but if the leader trusts the wrong people in the management to do specific tasks and these employees failed him, the quality of output will be affected. Theory Z may be taken in a brighter light so there may be fewer complications. It encompasses long term employment, specialized career paths and other holistic concerns for the employees. The theory may seem to be idealistic but there will still be conflict since the workers will be the one who will resort to solving the issues. Hence, managers won’t be touching issues causing poor control over matters. Finally, the systems approach can help in outsourcing ideas but then again, accepting changes pose the risk of having a negative feedback. The transformation may also alter some organizational traditions. The schools of organizational theories take on an effect of a double-edged sword. Some may help in facilitating tasks while some may worsen given situations. In a keen manner, the right theory to adapt for the company should be identified. Looks and Love Before I left home for college, my group of friends and I sat down for one last serious heart-to-heart. Sometime during our conversation, the question of college choice arose. Emotions escalated as we realized how far apart we would be in a short time. "Why did you choose to go to MIT?" they asked, "Why couldn't you just stay home at a state university?" Wanting to lighten the mood, I replied, laughing, "That's an easy one...the guys, of course!" And after the initial uproar of laughter died down and the comments about geeks and scrawny computer nerds subsided, I said, "I'm serious." I was. Where else would I find an intelligent and genuine guy who would be mature enough for me? When I arrived in Massachusetts and classes finally started, so did my "man mission." Most of the men I met blew the boys back home out of the water, and one lucky day, I peered past my twirling pink pen and found Him. The more I learned about Him, the more enamored I became. Yet I, a usually outgoing and assertive young woman, felt uncomfortable approaching this wonderful person in that more-than-a-friend kind of way. The worst part about the situation was that I knew exactly where my uneasiness was coming from. Unlike the guys at home, where seventy percent of the young male population had black hair and dark brown eyes, this guy was blonde and fair-skinned, a stark contrast not only to the male population back home, but to me. I am not a racist person, but the petty idea that this guy did not share like features with me, hindered me from appreciating what we did share and made me more aware of the differences between us. So where then, did this silly idea of single race relationships come from? Why did He an... ...zines remind me that this relationship would not be the most socially accepted or ordinary thing to do. But it is ordinary. I know I've fallen for this guy because of his humor and quirkiness, his intelligence, his kindness, and his character, things that I should be looking for. So now, I sit here in my baggy calf-length skater shorts and bright orange hooded sweatshirt and stare across the seats, focusing on his neatly ironed khakis and dark blue dress shirt, and think that our hypothetical relationship would die quickly. I'm still that closed-lipped girl from the beginning of the story when it comes to my feelings because I don't want to be rejected, and for some reason I feel like we might not be right for each other, even though I know we are. And it depresses me that somehow, our ad-driven society is probably convincing him of that same exact thing.

The Limit of Power: The End of American Exceptionalism In The Limit of Power by Andrew J. Bacevich, he argues about the major flaws Of United States with a general theme of â€Å"freedom† and how the U. S has an imperial ambition that uses military to try and guarantee ongoing consumption by the public for the economic power of the elite. Also he says that the fundamental flaw of American Foreign policy lies in the Imperial Presidency and the permanent Nation Security that controlled the formulation and executive of American Foreign Policy throughout the Cold War.This partnership grew and it is now entrenched in our bureaucracy since that time. From this Bacevich identifies three crises that the United States is facing: crisis of profligacy, political crisis, and Military crisis; but the current crisis presents an opportunity to fundamentally address our course or face certain and dramatic decline. First the author introduced the title â€Å"The Limit of Power† as Unite d States search for freedom that has raised responsibility and surged the country with mass amount of increasing debt; without a solution to pay it off.Then he ties that in with the crisis of profligacy, where he discusses the ascendancy of the United States after World War II economic world order and the fundamental economic strength derived from the victory in the context of European and Japanese destruction. Earlier the United States achieved a stand of live that became the envy of the world, then that began to shift in the late Vietnam War period. This happened because post World War II the United States had been the number one producer of petroleum and later the companies determined the price of oil.Then there developed a decline that was irreversible and the price setting of crude oil became the responsibility of a new producing group, Organization of Petroleum Exporting Countries (OPEC) (p. 29). He moves on to talk about the economic decline and President Carters choice of en ergy dependency challenging Reagan’s optimism for the economy. This resulted in Reagan’s victory and a period of spending that was not supported by fundamental economic strength. Instead the trends then have only continued and debt has supplemented earning power in American life.Then the bills for the â€Å"profligacy’ eventually came due and the American way of life has outstripped the means available to satisfy it. In account to the political crisis, Bacevich argues that in the post-World War II, Congress renounced its role in the checks and balance system, allowing for the creation of the Imperial Presidency. The National Security rendered this situation intolerable by displacing the voters as the final conciliators of the American policy. Many Presidents come and go, but the National Security stays in place, much to the detriment of any President coming to Washington thinking they will actually change anything.Bacevich substantiates this with many examples of Presidents that become suspects of advisors. He also interposes the political crisis with a discussion about NSC-68; it provided the United States with an early sense of how the postwar habits of deferring to the Wise Men has wrought. The foreign policy exemplified by the two World War II era leaders, Henry Stimson and James Forrestal, showed their different styles; both were Wall Street republicans and served under Franklin D.Roosevelt, but yet they both had different traditions. When Stimson served, he exemplified the conservative reaction to circumstances and that meant that he was cool and measured. On the other hand James Forrestal was more of a pessimist and tended to emphasize potential threats as always imminent. Unfortunately it got to him so much that he broke down and committed suicide. Bacevich explained that while Stimson remained respected, the majority of advisors emulated Forrestal (p. 107).For the military crisis Bacevich builds on the previous crisis of profliga cy and political crisis and moves into the area of his greatest strength of military policy. He puts together the various forms of conventional wisdom as they emerged at various times. Also he think that’s the endless War on Terror represents a clear over-extension of American capability and if continued will accelerate decline. Financially, the sputtering War on Terror and the unrealistic expectations of the American electorate will combine to continue unrealistic policies that solve nothing.Bacevich then lays out that the axiom that all â€Å"Small Wars† are wars of empire, and that is not what we should be engaged in prosecuting. Bacevichs argument blamed the military and the Bush administration for the crises that is occurring in the United Sates as merely irrational. The crisis cannot be solved by sending men and women of this country to a war that is constantly degrading them. The author also mentions the Department of Defense for not doing their job and what the y actually do has nothing to do with their job description; instead it specializes in power protection (p. ). Bacevich sees no relevance for the Department of Defense with the exception of the war in Afghanistan and Iraq since September 11. He criticizes the government for reflecting its decision on the September 11 events. When the underlying problem is America’s failure to recognize that all our problems cannot be solved by replaces things like our head executive (president). The only way the U. S can move forward is realize that it is a hardworking, striving, independent country that long accomplished many things by working together to make American a place that it once was.Bacevich continues on his criticism of the Department of Defense for being more accurately described as the Department of Power Projection and it needs to get back to doing defense. Furthermore, he ends the military crisis chapter by stating that the essential problem is not the size of our Army, but wh at we are asking it to do. Military capability does not make up for age old fixed costs of conflicts. Moreover, any foreign policy needs to be grounded in sound fiscal policy otherwise it is unsustainable in the long run.For the most part I agree with Andrew Bacevichs viewpoints about the three of crisis that the United States is facing. He make a great point about how America and its citizens are a completely culture and have an entirely different mindset than just many decades ago. I completely applaud Bacevich for not holding back in diagnosing the problems that have long plagues the nation bust but are only now manifesting them to the public. This book is a must read because it is incumbent upon American people to arm themselves with what is happening to this country and what they can do as citizen.The focus is to first recognizing our limits then we can change the course of the United State. To an absolute great way to sum everything up Andrew Bacevich said â€Å"To hard-core nationalists and neoconservatives, the acceptance of limits suggests retrenchment or irreversible decline. In fact, the reverse is true. Acknowledging the limits of American power is a precondition for stanching the losses of recent decades and for preserving the hard-won gains of earlier generations going back to the founding of the Republic†

â€Å"There’s no place like home, there’s no place like home, there’s no place like home†, repeated Dorothy. A young girl trying to go back home to Kansas after a cyclone lands her and her dog, Toto, in the Land of Oz. There Dorothy meets the Scarecrow, the TinMan, and the Cowardly Lion who are all in need of something that is considered important to them; a brain, a heart, and courage. Along the way, they have to travel to Emerald City to see the Wizard of Oz, directed by the Good Witch of the North, especially for Dorothy to get back home.However, Dorothy and the gang run into problems with the Wicked Witch of the West, who wants Dorothy’s ruby slippers (which was originally the Wicked Witch of the East shoes). In America, in the late 1890’s, the Populist Movement was in full throttle. Populism is â€Å"government of, for, and by the people†. The Populist Party was a political party, which was a collection of various social groups ag ainst monopolies and the rich. In these social groups, included poor white farmers from the South; wheat farmers in the Mid-Western states such as Kansas, Nebraska; African- Americans; and Northern factory workers.These oppressed groups naturally didn’t agree with banks, railroads and the rich. The Populist Movement relates to the Wizard of Oz because it portrays the people of these places as fools because some actually do listen to these presidents who really don’t have the American people best interest at heart. Also, the events that occurred during the Populist Movement involving farmers, their hardships, oppressed workers, and politics mirrored Dorothy, the Scarecrow, the Tinman, and the Cowardly Lion. Therefore, this shows how the Wizard of Oz proves to be a political parable.In the text, Dorothy is a young girl who is always laughing and playing with her dog, Toto. She lives in the dry, Great Plains of Kansas with her Aunt Em and Uncle Henry, who is a farmer. The y live in a rundown looking house, and all around them was dull and grey. Dorothy represented an everyday women living in Kansas, just living a normal life during this time period. She also represents their values as well. Auntie Em and Uncle Henry show the everyday farmer. In the historical content, they portray the farmer who works day in and day out, but not seeing any benefits from their farming.In the book, a cyclone appears to come and takes Dorothy and Toto to this magical land named the Land of Oz. It turns out Dorothy’s house landed and killed the Wicked Witch of the East. The cyclone is supposed to represent the Populist Movement and the political upheaval it brought involving William Jennings Bryan, and the Granger movement. The cyclone could also represent a Silverite victory, when the Senate adopted a bill that prohibited the government from issuing money bonds without the consent of the Congress. It was basically to stop the government from using only gold at ti mes.During this time, farmers were suffering from issues involving supply and demand. They were making more and more of wheat/grain but the value of it was becoming less and less. They were receiving less money for their goods. They wanted money to be both silver and gold so it can be easy for farmers, and workers to make the same money, and have the rich make their money. The Land of Oz is a utopia where there was color, flowers, beauty, and birds singing in the tree. In the Land of Oz, lived Munchkins. They were supposed to represent other average American workers as well.When the Wicked Witch of the East died, they were freed of oppression. The Wicked Witch of the East represented factories and industrialized settings. Many of the farmers from the West blamed their problems on the wealthy and industry. Later on in the text, Dorothy meets the Good Witch of the North. The Good Witch represents a Northern electorate who had supported populism. The Good Witch sends Dorothy to go to t he Wizard of Oz, down the yellow brick road to Emerald City, who has the power to send her back to Kansas.The Good Witch also gives Dorothy the silver shoes, which also serves as protection. This can relate to the Bimetalism vs. Gold Standard. I say this because Dorothy shoes are silver and she is sent to go down the yellow brick road, which can be seen as gold bricks. This can be known as gold money. In this time, it was clear that silver vs. gold was important to the farmers involving the economy. The silver was supposed to be available for the working class, and would increase the amount of money for the working class. In the text, Dorothy meets the Scarecrow, the Tinman, and the Cowardly Lion.The Scarecrow represents the western farmers, and how their hardships and troubles from inflation caused them to have doubts and problems with their money. The Tinman represents the American worker who mostly has populist views. He also represents how the worker felt dehumanized and was hel pless. In addition to this, the Wicked Witch of the East put a spell on him that every time he swung his axe, he would chop a piece of him off. This would make his body smaller, in relation to his work being minimized by the government.The Cowardly Lion represents William Jennings Bryan. He supported the free silver movement. Bryan had a large impact during the Populist movement and fought for the rights of the common people. He wanted to make silver available as money for the working class, and not only support the industry and the rich. Together, all four of them took the yellow brick road to Emerald City. Emerald City represents Washington, D. C. The city is green and stands for money, and the economy. The green spectacles could be used as propaganda to cloud American people mind.When they get to the Wizard, he is a powerful and majestic character that seems to hold many powers. He orders Dorothy and the rest to kill the Wicked Witch of the West and bring back her broomstick. In the text they go through many obstacles due to the Wicked Witch. Soon after Dorothy, kills the Witch with water. It shows that the Wicked Witch of the West represents the untamed, and dry, drought plains in the West. When they returned back to the Wizard of Oz to bring back the broomstick, it was revealed that the Wizard was a regular, ordinary man, who really didn’t hold great power like his title.He represents a president, presumably from Grant to McKinley. It shows he fooled people into thinking he’s something that he’s not. He helps the scarecrow, the tinman, and the cowardly lion by giving them a brain, a heart, and courage. At the end of the story, it showed the wizard provide objects of self-illusion to clearly make the scarecrow, the tinman, and the lion feel better about themselves. The Good Witch of the South tells Dorothy that all along she had what it takes to go home, and by tapping her shoes three times she was able to go home.The fact that they ha d to have a â€Å"wizard† â€Å"fix† them and then at the end for Dorothy to lose her silver shoes showed that in the beginning, populism was strong but after the election of 1896, McKinley won, the issue of silver decreased. In conclusion, this story showed that the characters and events depicted in the text relate to American history. It showed problems with American society, economy, and politics. It therefore shows in some way that this is a political parable.

There are so many innocent kids who are continuously waiting for someone to be able to flip their life around and give them a permanent place to be. People don’t understand how many kids have been sent to the foster care from the birth parents giving up on them and abandoning them. The foster care is a organization who takes in kids and is paid by the government. Their job is to take care of the kids and try to find a â€Å"forever† home for them. The kids that are there weren’t given a choice. No one really understands how much the kids in the foster care are depressed. With all the time they spend having their hopes up to be placed in a good home. The kids are struggling with themselves, thinking they’re not enough to be wanted. Children in the foster care should have more support and helpful people to surround them. The problem today is with the government about foster care is that they really just don’t care who they place kids with. They are giving them to people who are unstable and are unfit. It’s wrong, but the government doesn’t really care who and where they are placing the kids. The government just wants to think that once they placed a kid, that they have done a good deed. In the article â€Å"Foster Care† written by Gale, states â€Å"The Federal government provides funds to States to administer child welfare programs.† which is saying that they have no interest for the foster kids at all. This quote is a prime example of why we as people need to come up with solutions for the government to start caring for these innocent kids. People have this description that the kids are in the foster care are dangerous. Finding ways to help the children who are in bad homes is something very important. These kids are getting sent from house to house and reason is because the people who get their license to foster just want the money. The money that the people who foster get, is welfare for the kids for clothes and food, but so many people misuse the money all the time. In this article â€Å"2006 creating more and better foster families† talks about helping the kids who have been placed in bad home. These two people created an organization that has grown which is a nonprofit to benefit the children and not all about the money. It states in the article that while setting up the organization, they â€Å"   Organizing circles of church members who will help the families that volunteer to foster or adopt† Having there people in the world is just incredible not only are they helping the kids, there giving them joy. These people are doing such an amazing deed to the world that is making lif e changing decisions. Another way that can help the foster care is having a seperate home for the children with disabilities. Its noticed that they place any kid in the foster care and don’t really care if they have a mental issue or a disability. While researching, came across an article about creating a home for the children in foster care with disability and giving them more attention and more care. In the article it states, â€Å"Despite the issues of best placement, children and adults with disabilities continue to be placed in foster homes† and as this is happening there are now homes that is part of the foster care, but is for the kids with disability. Which is amazing, even though it took a while it has been done. Now the kids with disabilities are in a safe home and have more attention to  their needs. Trying to find ways to help the kids in the foster care, their is an article that talks about how the state gets involve and helps out the foster care. The article â€Å" forever families† is a story about kids being able to find forever homes with the help of the state and also how the state helps the teenagers/adults who age out of the foster care. The author Mikel Chavers states, â€Å" States are taking the positive and working to improve the experience of children in the foster care system.† with the help of the states that means that more and more people are noticing how bad the foster system are treating the kids. So the state has this program for the kids age 18-21 which is that they have to find a job and the states provides them with a home. This program is called independent living and it is giving the older kids a chance to be able to start their own life. Having this change just means sooner or later there will be bigger change and more people noticing. These are the solutions that have been found through articles that been researched for making the foster care system a better place for the children. In my Latinos in the U.S. class, we have access to all types of information in our quest to learn about Mexican-American history. By reading Zaragosa Vargas= Problems in Mexican-American History, looking at the Chicano Park web site and viewing part one of the Chicano! video documentary, I have encountered a variety of representations of Mexican-American history. However they are not all of the same quality for the video and web site do not give as much information as the readings in Vargas= book or the class lectures and discussions do. Both the video and web site touch on a very small portion Mexican-American history, however, they only refer to the Treaty of Guadeloupe Hidalgo established in 1848 and that Mexicans are of Aztlan heritage. Chicano Park, is an area seventeen miles north of the United States-Mexico border in San Diego County. It was established in 1905 as Logan Heights and became known as Barrio Logan by the large Mexican population that exists in it. This population has a distinguished history that is told in the web site. One may think that this is the history of all Mexican-Americans, but it is not. The effect of certain events that occurred in Mexican-American history on this community and California, such as the Chicano Civil Rights Movement and the Chicano Moratorium march against the Vietnam war, is addressed. The film entitled Back from Madness: The Struggle for Sanity is a full-length documentary that primarily provides the viewers an in-depth view with regard to the world of insanity that few people have ever seen. This documentary focuses on depicting and exploring the personal and/or actual experiences of the four psychiatric patients, namely Todd, Naomi, Glen and Eric, for a couple of years that span from the time they are admitted at Harvard’s Massachusetts General Hospital.The documentary serves as a good piece in assessing the experiences of psychologically-ill individuals and the responses of science in addressing the difficulties faced by the patients. More specifically, it has a great impact on the study and practice of psychology. From an observation of the patients, the four specific criteria of psychological disorders are apparent. The four criteria of psychological disorders are distress, risk, impairment, and socially/culturally unacceptable behavior (Halgin & Whitb ourne, 2007).Distress and impairment is seen from the experience of Glen, who consistently washes his hands and other tasks that require much of his energy in repeated cycles. This makes him feel distressed as it interferes in his daily normal activities. Risk is very obvious for Eric who has fallen into a state of depression that leads him to become suicidal. With his inability to play his instrument, as a part of a major orchestra, he developed fears of failure.Conduct of socially unacceptable behavior is seen in the experience of Naomi who is disturbed by her hallucinations as she claims to hear voices that came from the sky. The voice she hears overpowers her, too. Lastly, Todd engages in socially unacceptable behavior and resists to taking his medicines regularly that consequently leads to him being sent to the hospital and in jail. Two patients that are of worthy attention are Naomi and Glen, who are 23 years old and 53 years old, respectively.Naomi is diagnosed with schizophr enia and shows to be a patient who has hallucinations and delusions. She reports that she sometimes hears people talking even if it does not occur in reality. However, contrary to the usual symptoms of people with schizophrenia, Naomi has normal speech and behavior patterns. She behaves like most of the people and she is not having problems with speaking. Likewise, the way she expresses her emotions is still within the normal range and is in no way different from that of the other people.She desires to be given the right medication in order for her to continue with her studies and live a normal life without suffering from the symptoms of her disease. The other patient, Glen, is diagnosed with obsessive compulsive disorder and shows the typical symptoms of people who are suffering from this illness. He has shown the inability to prevent himself from repeatedly doing things and this behavior has led to distress and leads to disruptions in the daily routine, tasks, and relationships wi th other people.His condition is classified as among those which are severe in nature and requires treatment in order for him to be able to live a normal life and be able to undertake the tasks and responsibilities he has. As for schizophrenia, the common treatments involve psychotherapy and medications, which is both reinforced through the family and the self (Grohol, 2006). In watching the experiences of the three patients, the hardest to watch is that of Todd as he has the different experience compared to the other three patients. Where the three others are able to have the persistence in seeking for medical help, Todd projected himself as the patient who would rather be free and went through refusals in drinking medicines regularly.Among the four patients, he has the least chance of getting better and is less successful in counteracting the symptoms and difficulties felt. Civil liberties, Habeas Corpus, and the War on Terror have been the forefront of Congress since 2001 with the terrorist attack against The United States. Although there have been many attacks before, none have hit the American people in such a manner to question whether our civil liberties are at stake. As a member of the Armed Forces I swore to support and defend the constitution of the United States against all enemies both foreign and domestic at all cost. A sense of pride, loyalty and commitment engulfs me when I hear the words for equal justice and liberty for all when it comes to erving my country that practices and honors American citizen’s civil liberties. Unfortunately, the liberties that most Americans take for granted; are the same liberties that other people from different realms of the world come to obtain. The War on Terror would impact lives deeply from this point on and the civil liberties of every American citizen and noncitizen would change the history of what we were founded on. Former President George W. Bush and his administration set out to capture those thought to be responsible for the terrorist attacks on American soil. In addition Former President Bush and his administration went to great lengths to go beyond the reach of the judicial system which enforces the writ of Habeas Corpus. These actions have been highly debated across the nation. Habeas Corpus original meaning can be best defined as a demand by the courts to which a government agency produces a prisoner and demonstrates that they have the proper grounds in which to hold them. â€Å"It is the process by which Common Law countries ensure the second freedom mentioned in the U. S. Declaration of Independence Liberty and the right not to be imprisoned arbitrarily in its most fundamental form† (MacMillan, K, 2010). Habeas Corpus was written into the first article of the constitution reading as such: â€Å"The privilege of Habeas Corpus shall not be suspended, unless when in cases of rebellion or invasion, the public safety may require it. No bill of attainder or ex post facto Law shall be passed. â€Å"(Article 1, Section 9, U. S. Constitution). Furthermore, the Habeas Corpus in the U. S. Constitution guarantees the people the right to require the government to justify detaining or imprisoning, the right not to be outlawed without fair trial, freedom from laws passed after fact. So the questions to ponder about re: Did the tragedy of September 11th, justify the actions of the Former President? Is it fair that prisoners were and still are locked away, and stripped of their basic rights under the writ of Habeas Corpus? And is the â€Å"Land of the Free and the Home of the Brave† such a great nation, that is so powerful that the laws that were put in place to protect civil freedoms and liberties, do not apply to us? Jonathan Turley, professor of constitutional law at George Washington University stated, â€Å"What, really, a time of shame this is for the American system. What the Congress did and what he president signed today essentially revokes over 200 years of American principles and values. † I agree whole heartedly about this comment. The President’s decision to deny the detainees Prisoner of War (POW) status remains a point of conflict, especially overseas with some arguing that it is based on an inaccurate interpretation of the Geneva Convention for the Treatment of Prisoners of War, which the assert requires that all combatants captured on the battlefield are entitled to be treated as POWs until an independent tribunal has determined otherwise. One notable date in military history is on October 17, 2006, when President Bush igned a law suspending the right of habeas corpus to persons â€Å"determined by the United States† to be an â€Å"enemy combatant† in the Global War on Terror. President Bush’s action drew severe criticism, mainly for the law’s failure to specifically designate who in the United States will determine who is and who is not an enemy combatant. This however was not the first time in the history of the U. S. Constitution that it’s guaranteed right to Ha beas Corpus has been suspended by an action of the President of the United States. In earlier years of the U. S. Civil War, President Abraham Lincoln suspended writs of habeas corpus. Both presidents based their action on the dangers of war, and both presidents faced sharp criticism for carrying out what many believed to be an attack on the Constitution. President Bush suspended writs of habeas corpus through his support and signed into law the Military Commissions Act of 2006. This bill granted the President of the United States almost unlimited authority in establishing and conducting military commissions to try persons held by the U. S. in the Global War on Terrorism. In addition, the Act suspends the right of â€Å"unlawful enemy combatants† to present, or to have presented in heir behalf, writs of habeas corpus. â€Å"Members of volunteer corps, militias, and organized resistance forces that are not part of the Armed Forces are entitled to POW status if they meet the criteria specified in the treaty. Groups that do not meet the standards are not entitled to POW status, and their members who commit aggressive acts may be treated as civilians under the Geneva Convention Relative to the Protection of Civilian Persons in Time of War†( Terrorism, the Laws of War, and the Constitution Policy Archive ). These â€Å"unlawful combatants† are not afforded immunity for their ostile acts. [A petitioner must be treated as a prisoner of war until a competent tribunal has decided otherwise, and that a military commission may not proceed with their trial. Although 250 detainees (including three children under the age of 16), 13 have been released from the detention facilities at the U. S. Naval Station in Guantanamo Bay, Cuba, and some detainees are being rewarded for cooperation with better living conditions while the status and treatment of detainees who remain in custody continue to be a source of contention] (â€Å"Enemy Combatants† Journal, Wuerth). Although the President has inherent power under the Commander-in-Chief Clause Article II to take measures he deems appropriate during wartime, he uses The law of war principle. President Bush as well as past presidents having been using this to detain, convict or, â€Å"(We understand Congress’ grant of authority for the use of ‘necessary and appropriate force’ to include the authority to detain for the duration of the relevant conflict, and our understanding is based on longstanding law of war principles. â€Å"); id. at 548-49 (Souter, J. ) Combat Status Review Tribunals (CSRT), which were established by the Defense Department, were put into place for the sole purpose of hearing the cases of the detainees. However, there are many flaws in having such a system determine the legality of one’s detention. The Supreme Court recognizes that the CSRT process for hearing cases puts many â€Å"constraints upon the detainee’s ability to rebut the factual basis for the Government’s assertion that he is an enemy combatant† (Boumediene v. Bush). Some flaws the court points out is that the CSRT assumes that the detainees are guilty before the trial has even started and it is all up to the detainee to prove that they are in fact, not enemy combatants. This goes against the typical US court proceedings when all suspects are presumed innocent until proven otherwise. The bias shown by the members of the CSRT puts the detainees at a disadvantage. Furthermore, while many of the detainees have a limited knowledge of English, they are not given the specifics as to what crimes they are being charged with because the information may be classified. Additionally, with no textual evidence, the detainees often go into the CSRT board empty handed and without legal representation. Not only do the proceedings of the CSRT seem nfair, it also seems to be designed to intentionally make it difficult for detainees to secure their freedom. In closing, the Founding Fathers placed the Suspension Clause in Article 1, Section 9 in the Constitution. This is important because if the founding fathers specifically intended to apply the Suspension Clause to US citizens only, then they would have placed it in the Bill of Rights which are specifically reserved for the people to protect them against the government. Furthermore, the rest of the clauses in Article 1, Section 9 specifically state what types of activities that the Legislative Branch cannot do. Hence, the Suspension Clause, because of its placement, was intended to be a limitation upon the abuse of power by the Legislative Branch. Lastly, the principle of separation of powers came from the idea that each branch would be able to check one another (Checks and Balances). The Military Commissions Act (MCA) of 2006 was an amendment to the Detainee Treatment Act (DTA) which did not allow the Federal Courts to hear writs of habeas corpus from the detainees at Guantanamo Bay. The US Supreme Court decided that because the DTA was an inadequate substitution for habeas corpus, then the MCA annot strip away Federal courts jurisdiction to hear habeas corpus cases. The Military Commission Act of 2006 effectively stops the Judiciary Branch from doing its job therefore making the act or Bill unconstitutional. . So as I read and watch videos to acquire information I ask myself, Are not constitutionally correct? Detainees, Enemy Combatants, or POW should have the same fair and equal treatment whether it is on our soil or their soil. Presidential power, Congress and the Supreme Court should not rule on emotions, but on the principles that guide us as the â€Å"Greatest and most Powerful Nation in the world.

The stroy occurs during the Cold War, in the 1950s and 1960s. The main character is Alec Leamas, a british agent in charge of East German espionage. He is recalled to the Circus, because there are no agents left. Control asks him to ’stay in the cold’. That means one last mission for him, his job is providing false information to the East German Communists.During his job in the libary he fells in love with his co-worker, a Jewish woman, Liz Gold. She is at the Communist Party in Britain. Leamas goes to jail because he assaults a civilian. He goes to Netherlands, then to East Germany, to the Intelligence Srvice. At the same time, George Smiley and Peter Gulliam travel to Liz Gold’s house, and have many questions about Alec. Leamas meets Fiedler, an East German spy, Mu ndt’s lieutenant, who joined the Communists and remained an anti-Semite. Mundt ordains the torturing and arresting of Fiedler and Leamas.Than it is a little complicated, becase Fiedler reports Mundt at the same day. I also find it hard to understand the situation from different eyes. We can get to know many characters thoughts. Sometimes I cannot decide which is the good side and the bad. It is very exciting and complicated, sometimes confusing. Fiedler discovers that Mundt is a double agent, and he was arrested before, but allowed to escape if he agreeing to work. Liz Gold’s apartment is paid by George Smiley and she promises Leamas to not to look for him after his leaving.Mundt gets to know these thing, and that those things happened before the murdering. Liz is sent to the jail with Leamas, and they are taken in a car together. Many things become clear. Liz gets to know that the British Intelligence intended to kill Fiedler. The end of the story is outrageous. Perso nally I waited for a happy end after many complicated and confounded situations. Liz and Leamas wanted to break the wire on the Berlin Wall, to escape to West Berlin. Leamas climbs up to the Wall and when he touches Liz’s hands, she is shot.Smiley tells him to jump down from the West side, but he climbs back. He is shot dead as well. I think he realised that he was a fool, he was manipulated and he had that chance to flee, but it did not work, so he gave up. I have never read such a story before, I have a sense that I have to read it once more, because there are many things I did not clearly understand. It is so lifelike and realistic that I can imagine it has happened in reality during the Cold War.
